1. About Biostarks and these Terms

AMR Labs SA, operating under the commercial name “Biostarks”, is a company registered in Switzerland under the number CH-550.1.254.220-3, with its registered offices located at Rue des Bosquets 31, 1800 Vevey, Switzerland (“Biostarks,” the “Company”).
In these Terms, the terms “Biostarks,” “we,” “us,” and “our” refer to AMR Labs SA.

These Terms & Conditions (the “Terms”) govern your access to and use of the Biostarks websites and any associated mobile or digital applications (together, the “Platforms”), and the purchase and use of Biostarks products and services, including at-home test kits, sample analysis, and access to results and reports.

Please read these Terms carefully before using the Platforms or purchasing any products or services. By accessing or using any of the Platforms, creating an account, placing an order, registering a test kit, or submitting a sample, you signify your assent and agreement to these Terms. If you do not agree, you are not authorized to continue use of the Platforms or the services.

2. Privacy Policy

Our collection and processing of personal data on the Platforms, including the types of information we collect and how we use, store, and protect that information, are governed by our Privacy Policy, which forms an integral part of these Terms.

3. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Platforms and services. By using the Platforms, you represent that you are legally capable of entering into a binding agreement and that you will use the Platforms for personal, non-commercial purposes unless expressly agreed otherwise in writing by Biostarks.

4. Nature of the Services (Important Disclaimer)

Biostarks provides wellness and informational services only. Our products, services, and reports are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. The information provided through the Platforms and reports does not replace professional medical advice, diagnosis, or treatment, and no doctor-patient relationship is created.

You should consult a qualified healthcare professional before making medical, nutritional, or lifestyle decisions, especially if you are pregnant, nursing, have a medical condition, or take medication.

To the extent applicable, Biostarks products, services, and reports have not been evaluated by the U.S. Food and Drug Administration (FDA). Biostarks products and services are not intended to diagnose, treat, cure, or prevent any disease.

Your access to or use of the Platforms, products, services, reports, or communications provided by Biostarks does not create a physician-patient, healthcare provider-patient, confidential, or privileged relationship between you and Biostarks or any of its personnel.

Under no circumstances should you alter, discontinue, or initiate any medication, supplementation, dietary, or physical regimen based solely on information provided by Biostarks without first consulting a qualified healthcare professional.

You are responsible for carefully reading all product information, instructions, and labels provided with any Biostarks product. Individual responses to products, testing, or recommendations may vary, and results or experiences may differ from person to person.

You should consult your physician or other qualified healthcare professional regarding potential interactions between any Biostarks products or information and any medications, supplements, or treatments you are currently using.

5. Orders, Pricing & Payments

All orders are subject to acceptance and availability. We reserve the right to refuse, cancel, or limit any order at our discretion, including in cases of suspected fraud, unauthorized resale, or misuse.

Prices are displayed in the applicable currency and may change without notice. In the event of a pricing or typographical error, we may cancel the order and refund any amounts paid.

Payments are processed by secure third-party payment providers. By submitting payment information, you represent that you are authorized to use the selected payment method.

Order cancellations and post-purchase remedies are subject to our Refund Policy.

6. Shipping, Taxes & Customs

Shipping times are estimates only and are not guaranteed. Delays may occur due to logistics, customs, or events beyond our control.

You are responsible for any applicable taxes, customs duties, or import fees required by your local authorities. Biostarks is not responsible for delays, refusals, or additional charges imposed by customs authorities.

Cancellations, refunds, and replacements are governed by our Refund Policy, which forms an integral part of these Terms.

7. Accounts, Registration & Security

Creating an account may be required to register a test kit, access results, and manage reports. You agree to provide accurate, complete, and up-to-date information and to keep your login credentials confidential.

You are responsible for all activity conducted through your account. We may suspend or terminate accounts in case of misuse, fraud, or violation of these Terms.

8. Test Kits & Sample Collection

You are responsible for collecting and submitting your sample in accordance with the instructions provided with the kit. Improper collection, contamination, or delayed submission may result in an unusable or inconclusive sample.

We reserve the right to refuse analysis, withhold results, or declare a sample inconclusive if sample quality is insufficient or if instructions were not followed. No guarantee is made that results will always be available.

9. Sample Handling, Storage & Destruction

Samples are processed using unique identifiers and may be anonymized/pseudonymized to protect your privacy. Samples are used only for the requested analysis.

Samples may be stored temporarily for operational, quality, or legal reasons and are then destroyed unless otherwise required by applicable law or explicitly consented by you. Once anonymized, samples cannot be re-identified.

10. Results & Reports

Results and reports are provided for informational purposes only. Results may be delayed due to laboratory processing timelines, logistics, or other constraints. Results may be incomplete or inconclusive.

Biostarks does not guarantee specific outcomes or that results will be suitable for any particular decision-making purpose. You remain solely responsible for how you interpret and use any information provided.

11. Sharing of Results

You may choose to share your results with third parties (such as healthcare professionals). Any such sharing is your responsibility. Biostarks is not responsible for third-party use, interpretation, or reliance on your shared results.

12. Use of Materials on the Platforms

Biostarks created the Platforms to provide information about its company, services and products. Whilst considerable effort has been made to ensure that the representations of Biostarks products and services displayed on the Platforms are accurate and representative, slight variations, distortions and/or differences may be apparent when compared to the original product or actual results (for example due to technical issues such as browser or computer settings). Accordingly, Biostarks cannot be held liable for any differences.

Users may download one computer copy or print one copy of the material made available via the Platforms for their own non-commercial, educational, private or domestic use only, provided that proprietary notices, in particular intellectual property notices such as copyright©, trademark™, are preserved intact and are not modified, deleted or changed. Unless otherwise stated, Users should assume that everything that they see or read on the Platforms (“Biostarks Material”) is protected by legislation and international treaties.

 Users are not authorized to sell, reproduce, distribute, communicate, modify, display, publicly perform, report or otherwise prepare derivative works based on or use any Biostarks Material for any public or commercial purposes without prior written consent. In the event of breach, the User’s permission to use Biostarks Material will automatically terminate and any copies must be immediately destroyed. Any unauthorized use may infringe copyright laws, trademark laws, privacy/publicity laws, and other regulations.

13. Submissions and Unsolicited Communications

This section concerns communications sent to Biostarks (excluding personal information shared for enquiries, services, or purchases, which are governed by the Privacy Policy).

Any unsolicited communication or material transmitted by the User to Biostarks via the Platforms or through social media, by email or otherwise, including data, questions, comments, suggestions, or the like, will be treated as non-confidential by Biostarks. By sending communications, the User grants Biostarks a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display such communications, alone or as part of other works, in any media now known or hereafter developed, and to sublicense such rights.

Biostarks cannot accept unsolicited proposals of collaboration or ideas. Users are advised not to submit inventions, concepts, or proposals.

14. Prohibited Use

You agree not to misuse the Platforms or services, including by: (i) violating laws; (ii) attempting unauthorized access; (iii) submitting samples not belonging to you; (iv) reselling products without written authorization; (v) attempting to reverse-engineer reports or the Platforms; or (vi) using the Platforms to infringe third-party rights.

15. Links & Linking

The Platforms may contain links to third-party platforms not affiliated with Biostarks. The inclusion of any link does not imply endorsement. Biostarks is not responsible for the content or accuracy of off-site pages. Accessing such links is at your own risk.

Biostarks does not authorize linking to any of its Platforms from a third-party platform without its express prior written authorization.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Platforms, Biostarks Material, and services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied. Biostarks does not warrant that the Platforms will be uninterrupted, error-free, secure, or free of viruses or harmful components.

Biostarks makes no representations regarding the suitability of its products or services for any individual and disclaims responsibility for decisions made based on individual health conditions, medications, or treatments.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Biostarks shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Platforms, products, services, or results, including loss of use, business interruption, lost profits, or lost data, whether in contract, tort (including negligence), or otherwise, even if Biostarks has been advised of the possibility of such damages.

To the maximum extent permitted by law, Biostarks’ total liability for any claim shall not exceed the amount paid by you for the relevant product or service giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply.

18. Indemnification

You agree to indemnify and hold harmless Biostarks, its affiliates, officers, directors, employees, agents, and partners from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Platforms or services, violation of these Terms, or infringement of any rights of any third party.

19. Termination and Suspension

Biostarks may terminate or suspend your access to the Platforms, with or without notice, if Biostarks reasonably believes that you have violated or acted inconsistently with the letter or spirit of these Terms, or violated the rights of Biostarks or any third party. Biostarks may modify or discontinue providing any of the Platforms at any time. Provisions intended to survive termination (including limitation of liability, indemnification, and general provisions) shall survive.

20. Updates to these Terms

We may make changes from time to time to these Terms. The latest version will always be available on the Platforms and will take effect upon posting. By continuing to use any of the Platforms, you agree to be bound by the updated Terms.

21. General Provisions

If any provision (or part of a provision) of these Terms is found to be illegal, invalid or unenforceable, that provision shall be deemed not to form part of these Terms, and the remainder shall remain in full force and effect, unless otherwise required by applicable law.

These Terms constitute the entire agreement between you and Biostarks regarding the use of the Platforms and services and replace all prior agreements and understandings. A waiver of any breach will not be deemed a waiver of any subsequent breach.

22. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without reference to conflict of laws provisions. Any dispute, controversy or claim arising out of or in relation to these Terms shall be subject to the competent courts in Switzerland, unless mandatory consumer laws provide otherwise.
