1. General
Biostarks has its registered offices at La Voie Creuse 16, 1202 Geneva (GE), Switzerland. In these Terms & Conditions, “Biostarks,” “we,” “us,” and “our” refer to this company, its parent company, and its affiliated entities.
These Terms & Conditions apply to all sales of products or services that you may order from Biostarks, including through our websites and associated mobile or digital applications, such as biostarks.com (collectively referred to as the “Platforms”).
These Conditions also outline the benefits, risks, and limitations associated with your use of the products and laboratory services provided by Biostarks (the “Products and Services”). As the individual who creates a user account or places an order, you are referred to as the “User,” “you,” or “your.” This section also explains how your information and sample(s) will be used during and after the provision of the Products and Services.
By placing an order or sending in your sample, you acknowledge and agree to be bound by our Terms of Use and Privacy Policy, which are incorporated by reference into these Terms & Conditions. You confirm that you have read, understood, and accepted these documents as binding agreements between you and Biostarks.
2. Privacy Policy
Our collection and processing of Personal Data on the Platforms—including the types of information we collect from Users and how that information may be used—are governed by the terms outlined in our Privacy Policy.
To protect your privacy, we assign each user who orders products or testing services from us an anonymous alphanumeric code (the “Client ID”). This is linked to the order using a separate anonymous code (the “Order ID”). Only Biostarks and its authorized subcontractors are able to connect the Client ID with the corresponding Order ID.
3. Voluntary Participation
Use of Biostarks Products and Services is entirely voluntary. By accessing our Platforms and choosing to place an order, you acknowledge that it is your personal decision to use these offerings.
Our Products and Services are only available in certain countries and regions. Availability may vary depending on your location, and Biostarks reserves the right to restrict access or sales based on geographic or regulatory considerations. Product or service availability is reflected on our Platforms based on your selected location.
By placing an order with Biostarks, you represent and warrant that you are a bona fide end-user customer purchasing for personal use—either for yourself or on behalf of another individual. You agree not to deliver, sell, or otherwise distribute our Products or Services for commercial purposes, unless you are an authorized healthcare provider, distributor, or business partner who has entered into a separate agreement with Biostarks permitting such use or resale.
4. Pre-orders
From time to time, Biostarks may offer the option to pre-order products that are not yet available for shipment. Pre-orders are subject to availability and will only be confirmed upon receipt of full payment. In such cases, the estimated delivery timeline begins from the date of our written confirmation of the order.
If product delivery is delayed as described in Section 12 below, you may contact us to cancel the relevant pre-order and request a refund of any amounts paid for products not yet received.
5. Account Registration
Creating an online account is not required to place an order. However, to access and fully utilize Biostarks Products and Services, users must register an account upon receiving a test kit.
This account enables the end-user to register their kit and link their sample to their unique profile. Our laboratory uses the anonymized Kit ID to identify each sample, and the platform reconciles this Kit ID with the Client ID to ensure accurate processing and secure delivery of test results.
6. Order Process
The process for ordering Products and Services on the Platforms typically includes the following steps:

We reserve the right to refuse, cancel, or terminate orders at any time for legitimate reasons. For example, we may take such action if there is an unresolved issue related to payment for a prior order or if we suspect, in our sole discretion, that you have engaged in (i) fraudulent activity, or (ii) any conduct that violates these Terms & Conditions.
7. Prices, Taxes, and Shipping Costs
Prices displayed on the Platforms may vary depending on your selected region or market. While our reference currency is Swiss Francs (CHF), prices may be shown in other currencies based on your location. Currency display and availability are subject to regional settings on the Platforms.
Applicable value-added tax (VAT) or other local taxes may be included in the displayed price or added at checkout, depending on the applicable laws and regulations of your delivery location. Final tax details will be shown before you confirm your order.
Shipping costs, if applicable, will be calculated during the checkout process based on your delivery preferences and location. These costs are not shown on product pages but will be added to your total before the order is confirmed and will also appear in your confirmation email.
We reserve the right to modify product prices and delivery costs at any time without prior notice.
We take reasonable care to ensure that all prices and delivery costs displayed on our Platforms are accurate at the time of entry or communication. However, errors may occasionally occur. In the event that a pricing or delivery cost error is identified after your order has been placed, we will notify you as soon as possible. If we have already accepted and processed your order in error, we reserve the right to cancel the supply of the affected Product(s) or Service(s) and refund any amount you have paid.
8. Payment
We accept the methods of payment identified during the order process on our Platforms. Depending on the selected payment method, we may request additional information, including specific forms of identification, to complete the transaction.
When placing an order, you will be asked to enter your payment details using the appropriate form. All payment card holders are subject to validation checks and authorization by the card issuer. If your card issuer declines payment authorization, you will need to contact them directly to resolve the issue.
Other payment methods may also be subject to validation and authorization by the relevant payment service providers. You expressly authorize us to perform any necessary security checks, including transmitting or obtaining information about you from third parties—such as updated payment information—to authenticate your identity, validate your payment card, obtain an initial payment authorization, and authorize individual purchase transactions.
9. Acknowledgement of Order
Once you have completed your purchase on the Platforms, you will receive a written Acknowledgement of Order (via email or other means). This document confirms the details of your order and includes an order reference number. Please save this number for any future questions regarding your purchase.
Note that the Acknowledgement of Order does not constitute acceptance of your order. We will first carry out our standard credit, anti-fraud, security, and legal checks. If your order is approved, we will proceed to process and fulfill it.
Upon receiving the Acknowledgement of Order, it is your responsibility to review it and ensure that it accurately reflects your intended purchase. If you notice any discrepancies or have questions, please contact us as soon as possible.
10. Shipping Policy
We only accept orders for delivery to the countries or regions made available and displayed as eligible during the Order Process on our Platforms. Shipping availability is determined based on your selected or detected location and may vary depending on regulatory or logistical constraints.
11. Confirmation of Order and Shipment
Once your order has been shipped, we will send you a written Confirmation of Order and Shipment, typically by email or another digital method. This confirmation serves as our acceptance of your order and provides details regarding the shipment.
12. Delivery
We will use reasonable efforts to ensure that your order is delivered by the carrier within the estimated delivery timeframe, starting from the date of our written Confirmation of Order.
If delivery is delayed due to unforeseen circumstances, we will make reasonable efforts to minimize the impact of the delay. If we do not deliver within thirty (30) days from the date of the written Confirmation of Order—or any alternative date we may have communicated to you, whichever is later—you may contact us to cancel the affected order and receive a refund for any Product you have paid for but not received.
In any event, your sole remedy for a failure to deliver shall be the right to cancel the relevant order and receive a refund of any sums paid for undelivered Products.
When estimating delivery time, please allow for payment approval, address verification, security checks, and order processing. Delivery is subject to receipt of full payment.
13. Procedures and Protocol for Biostarks Tests
When you create your account, we use certain information provided by you or on your behalf. We cannot perform the Services without collecting this information, but we will only collect what is necessary to deliver the Services you have requested. In order for the Services to be performed as intended, you (or a party acting on your behalf) must provide accurate and complete information, such as birthdate and gender. Failure to provide required information or to complete necessary documentation may result in your sample(s) not being tested. You certify the authenticity of both your personal data and your biological sample(s).
You are responsible for collecting your biological sample(s) using the collection method and instructions provided (typically five (5) well-formed drops of capillary blood via finger-prick). The sample must be sent directly to our laboratory, where it will be tested for a range of biomarkers and micronutrients. Please follow the sample collection and submission instructions carefully, as failure to do so may prevent us from properly performing the tests.
The results of your test(s) will be made available to you through our Platform. If formally authorized by you, we may also share your results with your designated healthcare provider. In the event a biological sample is deemed unsuitable for testing—due to sample content, improper collection, or submission in violation of these Conditions—we reserve the right to withhold results.
Reference ranges for all tests are established by our laboratory based on validation and proficiency testing protocols. In rare cases where a result falls significantly outside these reference ranges, Biostarks may, at its discretion, attempt to contact you using the information provided in your account.
14. Benefits
By using our Products and Services, you may gain a better understanding of your overall health and how your body functions. The insights provided through biomarker and micronutrient analysis can support more informed health-related decisions and lifestyle choices.

15. Risks
In order to utilize our Products and Services, you must collect the appropriate quantity of biological sample(s) for the test(s). Our tests require the collection of a blood sample using at least five well-formed drops of capillary blood. Although the risks and discomfort associated with finger-prick blood collection are generally minimal, you may experience temporary side effects such as excessive bleeding, fainting, light-headedness, bruising, hematoma (accumulation of blood under the skin), or infection (a slight risk anytime the skin is broken).
If you have a history of excessive bleeding, fainting during blood collection, hemophilia, or are undergoing anticoagulant treatment, we advise against using our tests that require self-collection of blood samples.
As outlined in our Privacy Policy, our Products and Services may reveal sensitive health-related information based on your biomarker analysis. As a result, you may become aware of certain health conditions, potential risks, or issues that were previously unknown to you.
If you experience any adverse reaction during sample collection, or if your results suggest a potential health concern, you should consult your general practitioner or another qualified healthcare provider. Our Products and Services are not intended for medical diagnosis or treatment and are provided for informational and general wellness purposes only.
16. Limitations
WE DO NOT PROVIDE MEDICAL DIAGNOSIS OR MEDICAL ADVICE. All information and content provided through our Products and Services—including text, graphics, images, videos, and other materials—is intended for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding your health or medical condition. Never disregard or delay seeking professional medical advice because of something you have read or accessed through our Products and Services.
Your test results are not intended for diagnostic purposes and are not a replacement for medical evaluation. Reliance on any information provided by Biostarks, its partners, or other users of the Products and Services is at your own risk.
Biostarks does not provide medical services, diagnosis, treatment, or advice. You understand and agree that the use of our Products and Services is strictly for general wellness and informational purposes.
While Biostarks takes reasonable steps to ensure the accuracy and reliability of the information provided, we do not guarantee the completeness, timeliness, or usefulness of any content or results. We are not responsible for your compliance with local laws or regulations in your country of residence.
Although we implement multiple safeguards to ensure quality, all laboratory testing carries inherent limitations. There is a possibility of false positive or false negative results. Factors such as poor sample quality, contamination, sample mix-up, recent blood transfusions, bone marrow transplants, illnesses, or certain medications may impact the accuracy or feasibility of testing.
Scientific knowledge and biomarker research are constantly evolving. New discoveries may alter the interpretation of your results over time. Biostarks is not obligated to update you if such information becomes available, although we reserve the right to contact you at our discretion.
17. Confidentiality
By submitting your sample or accepting these Terms & Conditions, you acknowledge that you have read and understood our Privacy Policy.
You agree that Biostarks is not liable for any unauthorized release of your results or personal information, unless such release is the result of gross negligence or willful misconduct on the part of Biostarks.
18. Legal Agreement
You give permission for Biostarks, including its representatives, affiliates, staff, agents, and designees, to perform the requested Products and Services on the sample(s) you provide, and to disclose your information and test results in accordance with our Privacy Policy.
By accepting these Terms & Conditions, you confirm that you are not accessing the Products and Services on behalf of an insurance company or employer, unless you are participating in a program or partnership explicitly authorized by Biostarks.
19. Limitation of Liability
To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions, and warranties relating to the Products, Services, and Platforms—whether express, implied, statutory, or arising from usage or trade practices.
Nothing in these Terms & Conditions limits or excludes any liability that cannot be limited or excluded under applicable law.
Subject to the foregoing, our total aggregate liability to you under these Conditions—whether arising in contract, tort (including negligence), or otherwise, and even if we have been advised of the possibility of such damages—shall not exceed one hundred percent (100%) of the price you paid for your order.
Please note that certain jurisdictions may not permit the exclusion or limitation of certain warranties or liabilities. In such cases, some of the above limitations may not apply to you.
20. General Provisions
Unless otherwise stated, the information and materials presented on the Platforms are intended solely to promote Biostarks' products and services and, in some cases, to offer those products for sale through various channels. Biostarks makes no representation that the content on the Platforms is appropriate or available in every country or jurisdiction. You are responsible for complying with local laws, especially if access to the Platforms or Biostarks content is restricted or illegal in your location.
While our products are available in many regions, certain products displayed on the Platforms may not be available in all countries or territories.
If any provision, or part of a provision, of these Terms & Conditions is determined to be illegal, invalid, or unenforceable, that provision (or portion thereof) shall be deemed severed and will not affect the validity or enforceability of the remaining provisions, unless otherwise required by applicable law.
These Terms & Conditions constitute the entire agreement between you and Biostarks regarding your use of the Platforms and replace all prior agreements, understandings, and representations—whether oral or written—related to this subject matter.
No waiver by Biostarks of any breach of these Conditions shall be interpreted as a waiver of any other or subsequent breach.
21. Children
If you are under the age of legal majority in your country of residence, or are otherwise not legally permitted to enter into a contract, you must not place an order yourself.
In such cases, a parent or legal guardian must place the order on your behalf and agree to these Terms & Conditions.
22. Updates to these Terms & Conditions
We may update or modify these Terms & Conditions from time to time. Please check this page regularly to stay informed of any changes.
The latest version will always be available on our Platform. Unless otherwise stated, any updated version will take effect immediately upon being posted and will govern your use of the Platform and your relationship with Biostarks from that date forward.
By continuing to use any of the Platforms after updates are posted, you agree to be bound by the revised Terms & Conditions.
23. Applicable Law and Jurisdiction
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Switzerland, without regard to conflict of laws provisions.
Any dispute, controversy, or claim arising out of or in relation to these Conditions—including their validity, breach, or termination—shall be subject to the jurisdiction options outlined below.
You may bring legal proceedings against Biostarks in either the courts of Geneva, Switzerland, or the courts of your country of residence. Likewise, Biostarks may initiate proceedings against you in the courts of your country of residence.
Before initiating any formal proceedings, both you and Biostarks agree to make reasonable efforts to resolve any dispute amicably within a period of thirty (30) days.
If you are a consumer residing in the European Union, you have the right to submit a complaint to an Alternative Dispute Resolution (ADR) entity. For more information or to locate an ADR entity in your country, you may consult the European Commission's Online Dispute Resolution platform.
